Terms of Service

Last Updated: 12/2025

These Terms of Service explain the rules and expectations for using our website and working with our marketing and analytics services. By accessing our website or becoming a client, you agree to these terms. If you have any questions, please contact us at [Insert Email].

1. Overview of Services

We provide marketing and analytics support for nonprofits. This may include Google Ad Grant management, Google Ads management, tracking setup through GA4 and GTM, reporting through Looker Studio, dashboard creation, data transformation services, and general consulting.

Our goal is to help nonprofits improve the visibility of their mission and increase meaningful conversions such as donors, volunteers, and signups.

2. Eligibility

To use our services, you must:
• Be at least eighteen years of age
• Have permission to act on behalf of your organization
• Agree to these Terms of Service
• Provide accurate information during the onboarding process

Nonprofit organizations must meet Google’s eligibility rules in order for us to apply for or manage the Google Ad Grant on their behalf.

3. Client Responsibilities

You agree to:
• Provide accurate information needed to set up and manage campaigns
• Keep all account access credentials secure
• Notify us of any major changes to your website, donation platform, or tracking setup
• Maintain compliance with Google policies that are required for your organization to use the Google Ad Grant
• Respond to reasonable requests for information or approvals that relate to your service agreement

If your organization uses the Google Ad Grant, you understand that Google may suspend or pause your account if its policies are not followed. We will assist with compliance as part of our service, but final approval always belongs to Google.

4. Payment and Billing

Our services may be billed monthly or according to a custom agreement.
Payments are due as stated on your invoice. If payment is not received by the due date, service may be paused until the balance is resolved.

For services that include a percentage of paid media spend, the percentage applies only to paid advertising outside of the Google Ad Grant.

All fees are non refundable unless required by law.

5. Service Modifications

We may update or revise our services at any time to improve performance or respond to industry changes.
If updates affect your current agreement, we will notify you in advance.

6. Results and Performance

We cannot guarantee specific outcomes such as a certain number of donors, volunteers, signups, or conversions.
Marketing performance can vary based on factors outside our control, including website experience, donation systems, search trends, competition, and user behavior.

We will always provide our best effort, expertise, and guidance to help your organization achieve stronger results.

7. Website Tracking and Analytics

If we configure GA4, GTM, or other tracking systems, you agree that:
• Tracking accuracy depends on your website structure and the tools you use
• You must notify us of website changes that may affect tracking
• We do not control third party tools and platforms, and they may update or change their features

We will assist with troubleshooting as part of the service package you select.

8. Data and Privacy

We follow strict privacy practices and comply with relevant laws, including GDPR, CCPA, and newer state privacy regulations.
Your data is used only to provide services and improve performance.

For full details, please review our Privacy Policy.

9. Use of Website Content

All content on our website, including text, graphics, branding, and design elements, belongs to us and may not be copied or reused without our written permission.

10. Third Party Platforms

We work with platforms such as Google Ads, Google Analytics, Google Tag Manager, and Looker Studio.
These platforms have their own terms and policies.
Your use of our services means you also agree to follow the terms of any platform connected to your campaigns or tracking systems.

11. Account Access and Permissions

You may grant us access to your Google accounts or website tools to perform services.
You agree that:
• We will use access only for the purpose of providing services
• You may revoke access at any time
• Revoking access may prevent us from completing agreed work

We are not responsible for issues that result from restricted or removed access.

12. Termination

Either party may end the service at any time.
When service ends, you remain responsible for any outstanding invoices.
We will remove our access to your accounts unless you request otherwise.

All work completed up to the termination date remains the property of the business unless stated differently in a written agreement.

13. Limitation of Liability

We are not liable for any losses or damages that result from:
• Website outages
• Third party platform errors or changes
• Incorrect data from third party tools
• Google Ad Grant suspensions or policy decisions
• Any actions taken by your organization based on our reports or recommendations

Our total liability for any claim is limited to the amount paid for services within the most recent thirty day period.

14. No Guarantee of Continuous Service

We strive to maintain consistent and high quality service. However, we do not guarantee uninterrupted access to our website, dashboards, reporting tools, or communication channels.
